Free access shows up in three shapes:

What counts as clinical notes software for therapists

Progress notes are the shared clinical record: what happened, what you did, how the client responded, risk if you assessed it, and the next step. They are not psychotherapy notes. Psychotherapy notes, under HIPAA, are the private counseling analysis you keep separate from the designated record set. Software that dumps process reflections into the progress note is the wrong container.

Capture. Some tools want a live recording. Some accept a typed or dictated summary. Some upload audio you already captured. Recording is a consent and storage decision, not a documentation shortcut. If a client declines recording, Emosapien still drafts from the therapist’s observations. Consent for a recording does not replace a BAA, and a BAA does not replace consent for a recording. They are separate permissions.

Export and chart handoff. Free clinical notes software that cannot leave the vendor’s screen leaves you retyping into the record. A free tier that publishes PDF export or copy-out gives the reviewed note a path into the chart you already keep. Do not assume write-back into SimplePractice, TherapyNotes, or another EHR unless that integration is published for the plan you are on. BAA on the exact tier. Protected health information (PHI) is identifiable client data in any form: a name, a date of birth, a phone number, or a session narrative that can identify the person. A business associate agreement (BAA) is the HIPAA contract between a covered entity and a vendor that creates, receives, maintains, or transmits PHI. HHS publishes HHS business associate agreement provisions so covered entities can see what that contract has to address. Encryption, a privacy page, and a “HIPAA” badge do not replace the signed agreement. A BAA on a paid plan does not travel down to a free tier. Emosapien’s BAA sits on Professional and Enterprise. The free tier is for evaluation, training, or de-identified material until that contract is in place.

Retention, deletion, access, and training. Drafts live somewhere. Someone can open them. Deletion either propagates or it does not. Session content either trains public models or it does not. Those facts sit on the exact plan, not on the homepage word free. Emosapien encrypts session data in transit and at rest, and session content is never used to train public models. That is a data-handling fact, not a claim that the free tier is PHI-ready.

A fictional 45-minute CBT follow-up in DAP is enough to see the product’s habits: a reported sleep change, an observed affect shift, a thought-record intervention, a PHQ-9 score with a date, and a specific homework item. No real name. No real date of birth. No real phone number. The same vignette in each account shows whether the draft names an intervention the session did not contain, whether risk language appears without an assessment, and whether the export lands in the dummy chart field the practice already uses.

De-identified evaluation is slower than dumping last hour’s session into a demo. It is also the only path that does not create a second copy of PHI in a system you have not contracted. The clinician still signs. A draft that you have not reviewed is not a note.
