Your practicum site wants a certificate before the first hour. The quote in your inbox does not say ACA on it. That mismatch is the whole decision.
ACA liability insurance for counselors is the HPSO-administered program the association endorses; American Casualty Company of Reading, Pennsylvania, a CNA company, is the underwriter and carrier. ACA’s member benefits page lists no-cost or discounted liability insurance, and the benefits table says members get discounts on coverage provided through HPSO. Non-members are marked not eligible. For limits, exclusions, and the policy form, read the HPSO quote and declarations. HPSO’s own page says ACA has endorsed HPSO since 2003, and that CNA is rated A (Excellent) by A.M. Best. Ratings move. If a placement site asks for the rating, confirm it on the current declarations or with American Casualty.
If you typed ACA counseling insurance or ACA malpractice insurance, you are on the same decision. The membership discount is not a second policy. The student benefit is not the licensed endorsement with a smaller price tag.
What you are buying
Start by confirming that HPSO is the administrator and American Casualty, a CNA company, is the carrier on the quote; then read the form and the two limits. A membership card answers none of those.
HPSO’s August 2025 comparison, on the ACA-members page, lists the policy form for its administered program as occurrence. The other-carrier cell on that table is blank, so it does not state the other policy form. Occurrence means a covered incident during the policy period can be reported later, under the terms of that policy. Claims-made is a different clock. If a direct quote is claims-made, ask what tail costs before you drop the occurrence policy you already have. Do not assume every other carrier is claims-made because HPSO left the cell blank.
Limits on the HPSO counselor page are up to $1,000,000 per claim and $3,000,000 annual aggregate. “Up to” is the ceiling you may be offered, not a promise that your approved policy sits at that ceiling. Employment status, state, and the application can change it. HPSO says rates, limits, and coverage vary by state, profession, and employment status, and that coverage depends on application approval.
The 2024 counselor claim report, published with CNA and HPSO, puts the average total incurred for a counseling professional liability claim at $157,492. That average sits under a $1,000,000 per-claim ceiling. An average is not your case. A single verdict can clear it. Read the per-claim number on your quote, not the average in a report.
Licensed counselor policy
If you are licensed and you buy through the member path, ACA liability insurance for counselors is an individual policy administered by HPSO and underwritten by American Casualty, a CNA company, with a discount.
The discount HPSO states for ACA members is 10% off the professional liability premium. The same page lists a new-graduate discount of 60% in year one, 40% in year two, and 20% in year three, plus 10% off if you complete HPSO’s online CE program. Every one of those lines carries the same caveat: available discounts may vary by state. A colleague’s renewal letter is not your rate.
License defense is the line people skip. On the HPSO counselor page, licensure defense expenses reimburse you up to $25,000 in aggregate for legal representation arising out of a covered licensure incident. Reimbursement means you may pay the lawyer and seek repayment from American Casualty, the CNA carrier, up to that cap. It is not the $1,000,000 liability limit, and it is not the defense HPSO says it pays on a covered professional liability claim. That lawsuit defense, HPSO says, is paid whether you win or lose, and it does not reduce the liability limits.
The same 2024 claim report lists an average counseling license-protection matter cost of $5,524. An individual investigation can still exceed the $25,000 aggregate cap. The most common license-protection allegations in that report are sexual misconduct, failure to maintain professional standards, and breach of confidentiality. If those are the complaints that actually land, the sublimit matters more than the headline limit.
Abuse and molestation coverage on the HPSO counselor page is up to $25,000 annual aggregate, as a sublimit of professional liability, and only where there is no determination of liability. HPSO says there is no coverage for criminal acts, including consensual sexual activity, and that this coverage is not available in New York. Do not read the $1,000,000 line as if it applied to a sexual-misconduct allegation. That sublimit is a term of the HPSO-administered program. Another carrier can write a different number. Read theirs.
A few other HPSO counselor-page figures are worth copying onto your checklist, then confirming in your state:
- Subpoena assistance pays an insurer-designated attorney to prepare you for a deposition, up to a $10,000 annual aggregate, even if you are not named in the suit.
- HIPAA proceedings help with patient notification expenses up to $25,000, and with fines or penalties where the law allows them. HPSO says fines and penalties are not available in New York.
- Assault coverage reimburses up to $25,000 annual aggregate for covered medical expenses or damage to your property if you are assaulted at work or while commuting. HPSO says this coverage is not available in Texas.
- Proceeding expense reimbursement is up to $1,000 a day, up to a $25,000 annual aggregate, for lost wages and covered travel when you must attend a trial, hearing, or proceeding as a defendant in a covered claim.
HPSO’s counselor page describes the coverage as portable and as including telehealth. State and employment status still change the policy. If you see clients on a screen, confirm the telehealth endorsement on the declarations, then use the telehealth malpractice insurance checklist for the location and emergency questions a liability quote does not answer.
Individual professional liability is not general liability for the practice. HPSO administers a separate business policy for the counseling practice. If you have an office, a W-2 clinician, or a landlord who wants a certificate, that is a second quote.
Liability insurance for counseling students
Liability insurance for counseling students gets mixed up because two products are administered through HPSO. ACA liability insurance for counselors, on the member side, is not automatically the certificate your practicum site will take.
The member benefit is what ACA lists: no-cost or discounted liability insurance, with HPSO discounts for members and no eligibility for non-members. Student limits, the training rule, and the policy form come from the HPSO student page or the certificate you are issued. If your program wants a certificate, the membership card is not that certificate. Read the notice ACA or HPSO actually issues you. If a figure is missing, leave the cell blank. Do not borrow it from a licensed colleague.
The direct student policy is the one you buy through HPSO without treating the membership benefit as the contract. On HPSO’s student page, professional liability is up to $1,000,000 each claim and $3,000,000 annual aggregate for a covered medical incident. Defense costs on that page are paid in addition to the limits, including investigation costs, whether the result is favorable or not. Coverage is for school-sanctioned and directed activities. After graduation, that page says coverage may extend to your professional duties at no additional premium for six months or until your next renewal, whichever comes first. Ask HPSO or American Casualty before you see a private-pay client in that window.
The same student page says most students can secure coverage for as little as $43 a year. The footnote says it may vary by state and profession. It is a floor on a marketing page, not your quote, and it is not a statement that the ACA member benefit costs $43. If the member benefit is no-cost for you, a $43 direct quote is the more expensive path, not the cheaper one. Compare the certificate you can hand the coordinator with the quote you can bind. Jordan’s mistake, in the example above, would have been copying the licensed $25,000 license-defense cap onto a student column the teaser never printed.
A placement site that accepts any student policy at $1,000,000 / $3,000,000 may accept the direct quote. A placement site that names the ACA certificate will not. Call the coordinator with the document in hand before you pay twice.
Buying direct
Buying direct means one of two things. You apply through HPSO without the member discount, or you apply to a different carrier. Either way, ACA liability insurance for counselors is the member-discounted HPSO-administered path, underwritten by American Casualty, not a promise that every other quote matches it.
Same HPSO-administered program and American Casualty carrier, no membership: you give up the 10% member discount, and ACA’s table marks non-members not eligible for that discount. The form and the limits can still be offered through HPSO if they approve you. A new-graduate discount, if you qualify, is an HPSO offer on that same page, not a reason to skip reading the declarations.
Different carrier: you are reading a new contract. Check the form, the two limits, the license-defense cap, whether defense sits inside the limit, the sexual-misconduct sublimit, and any state line that drops a coverage. HPSO’s August 2025 comparison says other companies may offer limits of $250,000 per claim and $500,000 aggregate, which HPSO calls possibly insufficient. That sentence is HPSO’s, about unnamed other companies, dated August 2025. It is not a survey. If your other quote shows $1,000,000 / $3,000,000, the low-limit warning does not describe that quote. If it shows $250,000 / $500,000, you now know why the ceiling felt thin next to a $157,492 average incurred claim.
The current comparison table does not confirm workplace-liability or workplace-violence counseling features: the cells for HPSO and other insurance providers are blank. A blank cell is not a finding about either policy. Read the quote in your hand.
A term one carrier offers is not a term every carrier offers. The $25,000 license-defense reimbursement, the New York carve-outs, and the Texas assault exclusion are terms of the HPSO-administered, American Casualty/CNA-underwritten program on the counselor page. Do not paste them into a column for a carrier that never wrote them.
Before you bind
Copy the template, fill one row per coverage item, and keep the student column and the licensed column from borrowing each other’s numbers. ACA liability insurance for counselors only helps if the column you fill is the policy you can actually hand someone. Then put the bound policy next to the rest of the launch list. The starting a private practice in counseling checklist still wants a license, an entity, a records home, and one referral. Liability coverage is one line on that list. It does not open the doors.
The note is the other half. A carrier that asks what you did in the session will not accept a memory. The therapy intake checklist is where you record what the client agreed to before the hour started. Session notes and follow-up are the record you can actually produce when someone asks. When you want that record in one place, see how Emosapien handles the session note.
